U.S. Senate Passes Bill with Questionable Terror Policies

The Senate passed S. 1867 a $662 billion Pentagon funding bill Thursday night after fights among lawmakers over terrorism-related provisions.  One such provision would authorize indefinite detention without trial and give preference to military detention of terror suspects instead of the civilian justice system.  Senator Marco Rubio suggests that these provisions could only be used on suspects with direct connections with organizations like Al-Qaeda but we know how well the Federal Government is at bending definitions.

The Obama administration threatened to veto the legislation, arguing the executive branch should decide how to try terror detainees despite this, the liberal Michigan Democrat and Senate Armed Services Chairman Carl Levin, rejected call after call by senior Obama administration officials to overhaul how his defense bill handles the treatment of suspected terrorists.  Both parties emerged disagreeing over whether the law allowed or disallowed indefinite detention of Americans.  But after an outcry conveyed by both liberals and conservatives, lawmakers arrived at a compromise that essentially concluded the indefinite detention was allowed while saying current policy wouldn't change.


A few Republicans led by Kentucky Senator Rand Paul, have railed against provisions that Mr. Paul argued violated the Constitution, aligning himself with liberal Democrats.  


This legislation is along the lines of the Patriot Act. Disguised as a simple funding measure, it's actions and amendments in my opinion will continue to hamper our rights and freedoms.

Constitution Day

Constitution Day commemorates the formation and signing of the U.S. Constitution by thirty-nine brave men on September 17, 1787.

This is the day when all those founders signed the United States Constitution, granting the citizens of this great country a Republic, if we can keep it.

It’s important to remember that not only did we claim our independence from England which is the focus of the July 4th Celebration but on this day back in 1787 our Founders locked in place a system that has protected our unalienable rights and our freedom for 224 years. So for that achievement, today we celebrate the birth of our great republic, the United State of America, by reading the great document which made it possible.

President Obama now supports Prolonged Detention

The president just said that he is moving forward to build a system for prolonged detention that is not currently legal. His words, "A new Frame work" Needs to be built.

Jesse Jackson Jr. explains how to fix the U.S. Constitution with Broken Windows

This is the soundbite I've been waiting for.

I've been arguing against Obamacare with every leftist who dares to try and convince me for over a year now. Each time I raise the same point. Why is it that the Government should provide a service, why is it that Health Care is all of sudden a right, why stop there, why stop with Health Care? Shouldn't we all be entitled to a home and a car, maybe a computer with high speed internet access. Usually these leftist are too intelligent to agree with me. They quickly back away. "No, No, that's not the same thing", they say. "Health Care is different.", they say. "Health Care is a right everyone should have health care", they say.

At this point I usually ask why is it different, if health care is right now how long will it be until a car is right, a home, a computer? There is never a good answer to this question. Well now there is a good answer, the answer is NOW. Here we have Jesse Jackson Jr. on the floor of the House, calling for a change to the United States Constitution as the only solution to our nations problems. The change he suggests we need to make of course is Broken Windows.

The Constitution is not "Living"

The Constitution of the United Stated of America is the document that organizes our system of government and secures our rights as citizens of this great Nation. You might have heard or read in recent time that this document is a “Living Document”. You might even recall that Al Gore made this point in 2000 during the presidential campaign. You may also be aware that Barrack Obama supports this concept as he wrote in his book, “The Audacity of Hope”. Many others also support this idea and have written about it over the years but does that make it a reality?

Progressives believe this wholeheartedly as it was they who originally started this concept, going back to Presidents Theodore Roosevelt and Woodrow Wilson as well their Supreme Court Justices Louise Brandeis and Oliver Wendell Holmes. They created the idea that instead of referring to the actual document we could refer to our own case law and their decisions in future matters. They believed they knew better than the founding fathers. These very same progressives were those who supported eugenics’ and it’s use it to eliminate the black race. These initiatives where hidden in plain sight mixed with more tame ideals such reductions in corruption and improvements to government efficiency.

Ask yourself if our Constitution was intended to be a “Living” Constitution why is that we never heard of witnessed those words until 1937 when Prof. Howard McBain wrote a book with that title. No earlier record shows any reference to this and you certainly will not find this mentioned by any of our founding fathers but our education system teaches this as a guiding principle to our youth. There is no shortage of this concept anywhere you look so to the undiscerning eye this seems like a logical and sound rationale. You will read books and articles by classically trained Authors and journalist referring to this concept like it’s understood fact without regard to the original source documents.

Now the Progressives of the early 20th Century did bring us some key ideas that I will not attempt to challenge here although each can be in great length. They did bring us Child Labors laws and the idea of “Trust Busting” as well as Prohibition. OK, maybe Prohibition didn’t work out so well, but I digress. They also supported Conservationism and Reclamation as well as Union Labor. Even though they are responsible for these changes does not make it right for them to change the entire foundation of our Government. Let us not overlook or dismiss the thoughts and words of those who designed this great nation.

In Federalist 45, ”the powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite”. The Constitution from its very origin was the frame of a national government made up of special and enumerated powers, and not of general and unlimited powers. Thomas Jefferson said it best, “Let no more be heard of trust in men, but bind them down from mischief by the chains of the Constitution.” And possibly the most powerful of his arguments, “On every question of construction carry ourselves back to the time when the Constitution was adopted, recollect the spirit manifested in the debates, and instead of trying what meaning may be squeezed out of the text, or invented against it, conform to the probable one in which it was passed.”

Do our leaders follow this guideline today? You be the judge.
